Comment Registration Reminder - Again

REGISTER, PLEASE
Let us revisit my friendly reminder about the need to register before you attempt to post a comment on this blog.  Even though the requirement is prominently posted at the top of this page over on the right-hand corner, some of you have not seen it or ignored it, or both.

"ANONYMOUS" NOT ACCEPTABLE
Several of you have attempted to post as "Anonymous', which is an unacceptable moniker for this blog.  It creates too much confusion, so please just be clever and pick a different handle if you don't want to use your own name.  If you select one that is already taken I'll let you know.

FOUL-MOUTHED BONEHEAD
Recently someone tried to post using an un-registered moniker and I just rejected it without reading it... we've had plenty of time to adapt and there is that reminder at the top of the page.  However, this person - obviously someone who supports your mayor and is operating with a VERY limited vocabulary and a significant unfamiliarity with the English language - later tried to post again, using the same moniker.  This time, though, he or she just raked me over the coals for not posting the earlier piece.  I went back and read it and would have posted it if the person had bothered to register.  However, because that requires him or her to identify themselves to me, I know that will never happen, especially now, after the load of foul language included in the last one.

A PLACE FOR DISCUSSION
Amusingly, this person accused me of failing to post opinions different than mine, which all of you reading this blog for some time know is just not true.  I WANT this blog to be a place where ALL sides of an issue can be discussed.  But, the gutless anonymous cowards out there just refuse to participate.  If they can't hide behind a tree and spew epithets, then they won't participate at all.  So be it.

Planning Commission Meeting Agenda Tonight

ONE MORE TIME
The Costa Mesa Planning Commission, chaired by the ever-dynamic Jim Fitzpatrick, will meet again this evening at 6:00 in City Council Chambers for what may be a fairly short meeting.

On the agenda tonight, HERE, are a couple of public hearings and two items under new business.

A FOURTH EXTENSION?
The first Public Hearing is a request for a FOURTH one year extension of a project that proposes building 26 attached three-story units with a handful of deviations, listed on the staff report, HERE.  The staff recommends approval of the request.

"CONTINUING" A CONTROVERSIAL PROJECT
The second Public Hearing is request to continue this item to the Planning Commission meeting of September 9, 2013.  This item, HERE, is Peter Zehnder's project in the 2500 block of Santa Ana Avenue that
generated significant public outcry when it was first presented on July 8, 2013.  You'll understand why when you read the list of variances, administrative adjustments, deviations and minor modifications involved.

SMART & FINAL NOMINATION
Under New Business there's a request from a resident to nominate the renovation of the Smart & Final store on east 19th Street for an award.

CODE ENFORCEMENT TICKETING PROCEDURE
The final item on the agenda, HERE, is a presentation by staff on how Code Enforcement violations are handled.  This should be interesting, since there's a lot of "urban myth" stories about Code Enforcement policies floating around these days.

WHY TWO MEETINGS A MONTH?
So, once again, the Planning Commission has very little to do at this meeting - which seems to be a habit ever since they decided to meet twice a month again earlier this year.  I'm still trying to figure out how this makes any sense from a "utilization of staff resources" standpoint.

Trouble In The City Of The Arts

WEEKS LIKE NONE OTHER...
The last couple weeks will be memorable in the annals of Costa Mesa lore.  Things happened that have most likely never, ever happened before throughout the entirety of Costa Mesa's history.

IMPROPRIETIES?
For example, after a rousing success with the 60th Anniversary Celebration the end of June, it looks like there's trouble in River City.  Two employees - those responsible for coordinating the event and guiding the activities of the committee appointed to plan the event - were placed on administrative leave and, a few days later, boxes of "stuff" were observed being moved from the 5th floor of City Hall to the Police Department, a few yards away.  Nobody is 'fessing up to moving the stuff, but logic tells us that it was likely one law enforcement entity or another.

INFORMATION FLOWS SLOWLY
We do know that Public Records Requests for information dealing with the financials of the 60th celebration have been responded to very slowly, in part, apparently, because much of the information requested is buried in the bowels of that "stuff".

A REAL "WHO DUNNIT?"
And then we have the Great Trail Mystery - the decomposed granite pathway that was installed on the sly, running along the Fairview Park side of the fence between the park and Waldorf School.  There are reports of men being seen installing the path - which encroached significantly on at least one  federally-protected vernal pool.  Although he denied knowing anything about the path, when he was shown photographs of it marked with flags showing the delineation of the boundaries of the pool, Mayor Pro Tem Steve Mensinger shifted into a different mode, apparently exclaiming something to the effect, "Well, what do you expect the kids going to school to do - walk through weeds?"  So, one presumes that Mensinger had prior knowledge of the path, and that it was "all about the kids" - his mantra for almost every breath he takes.  It has been reported that folks have photos of the trail being installed, and that there may be a familiar face or two in them.  We'll see.

THE FEDS DEFENDING THE FAIRY SHRIMP
One thing is sure... now that the federal government is involved - yep, they know about this transgression and apparently are NOT happy about it - extraordinary measures will be taken to discover who installed the path, and who authorized it.  It's my understanding that penalties could range from a simple slap on the wrist and the requirement to rehabilitate the destroyed pool to much more severe penalties imposed on the city for it's failure to be the good steward of those pools as agreed upon many years ago.

THE LAWSUIT
And then we have THE BIG EVENT - the lawsuit filed by Mayor Jim Righeimer, his wife Lene, and Mayor Pro Tem Steve Mensinger against the Costa Mesa Police Association - the rank and file officers charged with keeping us safe every day.  The suit also involves Private Investigator Chris Lanzillo, the law firm of Lackie, Dammier, McGill & Ethir for which he had worked and 25 John Does - unnamed folks they may wish to fold into the lawsuit later.

THE COMPLAINT
The forty-three (43) page document includes fourteen (14) causes of action in which Righeimer, his wife and Mensinger claim significant damages arising out of the much-publicized event last year when Lanzillo followed Righiemer out of councilman Gary Monahan's bar, called the police to report him driving erratically, followed him home and observed our most highly decorated DUI enforcement officer, Kha Bao, speak with Righeimer and resolve that the mayor had not been driving under the influence.  Then, it is alleged, that Lanzillo tried to run Mrs. Righeimer down when she approached his car.  Personally, I have a hard time with that last part, since the CMPD officer was still there and certainly would have seen such an act and arrested Lanzillo on the spot for assault with a deadly weapon.

PLENTY OF ERRORS
I've gone through the entire "Complaint for Damages" several times and it doesn't take long to find mistakes in the document, including inaccurately describing the mayor's election dates and ignoring the fact that Mensinger was elected to his position.  And, adding a little amusement to the document, in Paragraph 71 the text states: "Defendants' conduct, directed towards Plaintiffs, as  described herein, especially with respect to the INCIDENT, was outrageous and extreme and beyond the bounds of conduct tolerated by civilized society.  It was carried out intentionally, or wonton disregard of the probability of causing Plaintiffs to suffer emotional distress."  I guess it's pretty serious when Chinese dumplings are involved, huh?  I guess it's too much to ask your high-powered lawyer to run a spell check program, huh?

BOILERPLATE COMPLAINT
Peppered throughout the complaint are two paragraphs, boilerplate, describing the damage done to the plaintiffs.  Examples are paragraphs 81 and 82, which read as follows:

81. Defendants' above-noted actions were the legal and proximate causes of physical, psychological, emotional, and economic damages, and damage to their reputation Plaintiffs have suffered and continue to suffer to this day.  These actions of Defendants have also resulted in Plaintiffs incurring, and will require them to incur into the future, expenses for medical and psychological treatment, therapy, and counseling.

82. As a result of the above-described conduct, Plaintiffs suffered and continue to suffer great pain of mind and body, shock, emotional distress, physical manifestations of emotional distress, embarrassment, loss of self-esteem, disgrace, humiliation, and loss of enjoyment of life; have suffered and continue to suffer and were prevented and will continue to be prevented from performing daily activities and obtaining the full enjoyment of life; have and will continue to sustain loss of earning capacity; have and will continue to suffer damage to their business reputation; and have incurred and will continue to incur expenses for medical and psychological treatment, therapy, and counseling.  They have also suffered economic business loss as a result
.


THIS IS SERIOUS STUFF - IF TRUE
I don't know about you, but I think that's pretty darn serious, particularly since it's repeated over and over and over in the Complaint.  I honestly worry about the physical and mental well-being of our mayor and mayor pro tem and wonder, considering the apparent extent of their "injuries" in this case, how they can be expected to fulfill the duties of the jobs to which they were elected.  I mean, these disabilities seem very severe, which will certainly be borne out when all their medical records and financial records are subpoenaed and when they are deposed for the trial.

SHOULD THEY STEP ASIDE?
Perhaps, in the interest of their health and financial well-being, we should ask them to step down and permit those chairs on the dais to be filled with people more temperamentally suited and physically and emotionally more stable.  Both Righeimer and Mensinger have frequently complained about the pay for the hours they devote to city business.  It would seem appropriate, especially under the circumstances, that they step aside so they can devote more time to providing a good life for their families and to get their mental faculties back in order.  Of course, reading that complaint, it seems they doubt they will EVER be able to accomplish that.

WHAT ABOUT STEVE?
I don't get the damages to Mensinger, but maybe he's a very sensitive guy.  From what we know now, he was not followed home, but was left at the Monahan's bar when Righeimer took off and was followed by Lanzillo.  Is he mad because he'd have to buy his own Diet Cokes?  I guess we'll find out when he's called to testify about the damage he's suffered and the loss of income.  Doesn't one have to have a job to lose income?  Just askin'...

WHERE'S GARY ON THIS ISSUE?
And, as I read those complaints, I wonder about Gary Monahan.  After all, if we believe the story Lanzillo is apparently telling folks, he was in Monahan's gin mill with an attractive associate to entrap him into some kind of an illicit affair.  You'd think that if ANYONE should be feeling persecuted and be stressed out about this event it would be Monahan.  And yet, he is not a party to the lawsuit.  Doesn't that seem just a little peculiar?

TURNABOUT IS FAIR PLAY
And, as I read those complaints, I couldn't help think of the employees of the city who have suffered in the toxic workplace created by those two men for more than two years.  It seems to me that EVERY ONE of the phrases used apply precisely to most, if not all, the current and past employees who have had to deal with the capricious, thoughtless, heavy-handed methods those men have tried to use.  I wonder whether any of them - or all of them - have read this complaint and considered filing a similar action against Righeimer and Mensinger?  Seems like something to consider, doesn't it?


THE BIGGEST MISTAKE A LEADER CAN MAKE
All this chaos that has transpired over the past couple weeks - and, actually, for the past couple years - has made me contemplate just what kind of leaders we have trying to run this city.  I do know more than a little bit about leadership, having made a very nice living identifying and recruiting leaders in industry for more than three decades.  As I was contemplating Costa Mesa's leadership over the weekend a Facebook friend fortuitously posted a very interesting seven-minute video clip featuring several Harvard University professors and others who addressed "The biggest mistake a leader can make", which you can view HERE. But, before you click on that link, here's a sneak peak of some of the things they cited:
  • Putting self-interest ahead of the best interests of the institution or organization they run.
  •  Betraying trust.
  •  Being certain.  If you think you know everything, why bother to listen?
  •  Failure to live up to their own values.
  •  Being so enamored with their vision that they lose all capacity for self-doubt and lack the ability to look at the consequences of their actions.
  •  Personal arrogance  and hubris.  It's demotivating for most in the organization and increases the chances of making big mistakes.
  • Acting too fast.  Step back and consult, then act.
  •  When it's all about the leader, not in service of something bigger.
  •  Not being authentic, consistent and predictable.
  •  Not being self-reflective.  Failing to hold up a mirror to themselves and consider their impact on other people.  The worst leaders just bulldoze, plow through life, not learning through their mistakes.
DEJA VU
I watched that tape and, as I suspect many of you will, had this feeling of deja vu - like I've heard this all before.

NOT THESE GUYS
I've known some outstanding leaders in my lifetime - including some in this city - and was fortunate enough to work for a few of them.  The majority on the City Council - the people elected to lead this city - share none of the characteristics of those men and women I recognize as outstanding leaders.

WILL THEY STEP DOWN?
Perhaps Jim Righeimer and Steve Mensinger will step down to preserve their own mental and physical well-being - and to permit them to earn a living - and allow us to place true leaders in their chairs on the dais.  This city needs those kind of people in leadership roles - right now!

Controversial Park Entrances On Agenda Tonight

YOUR GOVERNMENT AT WORK
The Costa Mesa Parks and Recreation Commission, led by Chairman Byron de Arakal,  will meet again this evening in City Council chambers at City Hall beginning at 6:00 p.m.  You can read that short agenda HERE.

GET THERE EARLY
Right off the top, under Old Business, is the discussion of modification of two entrances to the park - at Pacific Avenue and Canyon Drive.  You can read that staff report HERE.
CONTROVERSIAL IMPROVEMENTS
This item was the subject of much discussion at the recent meeting of the Fairview Park Citizens Advisory Committee last Monday night.  I reported on it HERE.  More than 40 people attended that meeting to sign in on this issue.  I expect there will be at least that many at the meeting tonight, when the commission will vote on whether to accept the modifications from the original proposal and move forward with these improvements in the park.

REGISTRATION NOW REQUIRED TO "COMMENT"


EARLY, SHAKY DAYS
As a few of you who have read this blog from the very beginning already know, my first blog host - I referred to it as a "bargain basement host" - offered few frills, like the ability to use images or publish comments.  I rode along with that one for about eighteen months before bailing out and creating this blog, hosted by Google's Blogger.

IMAGES ENHANCE THE MESSAGE

This arrangement has been much more satisfying.  I can use images that emphasize my points.  I tease folks when they ask about those images by telling them that my readers are the comic book crowd, so they like funny pictures.  Actually, I think those images make the blog better... but, then, I would.  I suspect most of you agree.

MY GOAL

The "Comments" feature, however, is a whole different story.  When I first began publishing A BUBBLING CAULDRON my goal was to draw more folks into the discussion of what I thought were important community issues.  I know, for a fact, that I've been able to do that simply from the number of comments sent to the blog, and by personal anecdotes provided to me privately by readers who have become active in the community because they read something here that either provoked or inspired them. 

LOVE AND HATE

Some of you like what you read here, and some of you hate it.  I'm OK with both polar views.  I'd rather have everyone who reads this blog agree with me 100%, but I know that's not going to happen.  We all have opinions, no matter how wrong some may be.  OK, that's another tease...

MY HOPE FOR "COMMENTS"

My hope was that the "Comments" feature would enhance the discussion of issues raised here - that opposing views could be articulated with passion and clarity in an attempt to convince each other of the wisdom of our respective opinions.  Sometimes that happens.  Sometimes it doesn't. To those of you who have participated in those discussions and kept the debate at a high level, thank you.  I REALLY DO want a broad discussion of issues and, as I've demonstrated in the past, I do my best to post both sides.  I really do want your participation because, quite honestly, many of your comments are much better than mine and explain issues much more thoroughly.

BIG CHANGES!  A NEW DAY...

However, way, way, way too often more than a few of you - on both sides of issues - use the anonymity afforded by this comments feature to just be plain nasty and rude  Your snide, caustic innuendo and flat out crude remarks contribute absolutely nothing to the discussion.  You wouldn't speak that way to your mother, but you do here assuming nobody will know who you are.  Well, those days are over.  I'm just tired of having to read all the crap that comes through, many of which I just automatically delete now because they are just unacceptable.  If you read through some of the recent comment threads you'll probably be saying, "Really?  You've received worse comments than these?"  Yeah, sadly, I have and still do.

...BEGINS NOW

So, I've decided to treat the comments on this blog like the old "letters to the editor" submitted to newspapers.  You had to sign those and the result was a fairly civil discourse.  I DO NOT want to shut off the comments completely, but BEGINNING IMMEDIATELY I will post no comments if I have not received registration by the author and verified it.  I understand the need for anonymity for some of you.  Fear of retribution is a very real fact of life these days.  I also understand that many of you are so gutless, such cowards, that you will never even consider posting if I know who you are.  To those folks I bid a not-so-fond adieu... don't let the door hit you in the butt on the way out.

HERE'S THE DEAL...
For the rest of you, I'm looking for a solution that will work without making too much more work for me at this end.  I thought at first that I'd require every commenter to register with Blogger in order to post, but that's not good enough.  I need to know who you are, and to be able to verify your identity if I feel it's necessary to confirm that you actually submitted the comment in question.  So, here are the new rules, which will mean a whole lot of work on my part, but may be worth it in the long run.  If not, and if I can't come up with a better solution - "Facebook Comments" is not an option - I'll just disable the comments feature.  I don't want to do that.  As I said earlier, I value your participation.

THE NEW RULES - MY TWELVE COMMANDMENTS
1 - Every person who posts comments on A BUBBLING CAULDRON MUST register BEFORE posting their first comment, even if they are registered on Blogger.  NO EXCEPTIONS!

2 - You MAY use your own name (my preference) and/or a pen name, but NOT the name "Anonymous". 

3 - Pen names MAY NOT be offensive, either in fact or by innuendo.  If the pen name you chose is taken or unacceptable I'll advise you by return email so you can pick another.

4 - You MAY NOT use another person's name.

5 - Only ONE person may use a specific pen name.

6 - You may NOT register under more than ONE pen name.  Pick one and make it work. 

7 - You MAY register a pen name AND your proper name.  Each requires separate registration.

8 - Foul language, flaming and other offensive language will NOT be posted.  If you have strong negative feelings on an issue, find a creative way to express yourself that demonstrates your cleverness, not your nastiness.  I'm the sole arbiter of what gets posted, but with a registration policy we can discuss it "off line", if necessary. That does not mean that I'm going to give you a call if I don't like your comment.  It either makes the cut or doesn't.  If you're anticipating rejection, send me an email.

I will still not be able to edit comment submissions.  It's a go or no-go situation.

10 - To REGISTER you MUST send me an email with the word "Registration" in the subject line to
thepotstirer@earthlink.net BEFORE submitting your first comment.  If you don't - if you are not registered - your comment will be rejected without notification to you.  Once registered your comments MAY be posted if you remain civil and focused on the issue at hand.  Of course, none of you will send nasty comments if you're registered, so I'm not really concerned about that.

12 - I GUARANTEE TO YOU that your identity,  email address and telephone number will be held with complete confidentiality.  NOBODY else will have access to that information.

TIME TO REGISTER IS NOW

OK, those are the new rules.  I hope those of you who choose to continue to participate in the discussions here will take a couple minutes to send me an email with the information required to register.  Please don't wait until you've got a head of steam up on a subject, spend a lot of time telling me and the readers your views, only to have it summarily rejected because you're not registered.  Register now.  There is NO grace period

PRETEND IT'S YOUR MOTHER... 
It's not a rule, but when you submit a comment I hope you'll pretend you're making your case to someone you respect greatly - it doesn't have to be your mother - and try to keep the personal attacks and vitriol out of it.  Remember, I still decide what appears.  In the past some otherwise excellent, relevant comments have been rejected because of some unnecessary nasty, over-the-line slam about someone.
 

LOOKING FOR QUALITY, NOT QUANTITY
I expect the number of comments on this blog will drop like a rock, at least for awhile.  I know we will never again see those 100+ comment threads because many of you just like to shout at each other and I'm eliminating most of that opportunity.  I do expect, though, that the threads will be more thoughtful, of higher quality and much more worth reading.  And, of course, the number of page views will also plummet.  I'm OK with that, too.  If I was trying to attract advertisers that would be a different matter.  I'd probably just let the free-for-all continue and let the hit counter spin away.  I'm going to write what I choose, the way I choose whether the readership drops or not.

HERE WE GO....

So, let's try this.  I know it might cramp your style in the beginning, but it will be worth it.  It requires a ONE-TIME STEP on your part - the registration.  And, of course, you have to remember that name you chose.  I will have to begin keeping records of registrants and contacting them to verify their identity.  Oh, yes.  I'm going to DISABLE THE "WORD VERIFICATION" FEATURE to make it just a little easier for you to post a comment.  The robots can try all they want, but nothing gets through unless they're registered.  Please tell your friends.  Thanks for your cooperation.  NOTE: The "Word Verification" feature has been turned back on.  Too many robo-comments.  Sorry about that.
