Righeimer On John & Ken Show Today***

GASOLINE ON THE FIRE
This afternoon, shortly after 4:00 p.m., Costa Mesa Mayor Pro Tem Jim Righeimer appeared as a guest on the John and Ken Show on Los Angeles radio station KFI640AM.  His comments on that show will certainly only add fuel to the already blazing fire of controversy about his recent encounter with the CMPD.

AUDIO PODCAST
You can follow THIS LINK to hear the audio podcast from that entire program if you choose.  Don't be frightened off by the counter that says 38 minutes.  The Righeimer segment is less than half that.

LISTEN CAREFULLY
While you're listening you'll hear Righeimer reiterate that "this was a set-up. I've seen this playbook before."

HE DEFINES THE LAW FIRM
During the conversation he addresses the law firm, Lackie, Dannmeier and McGill, where the man who reported him to the police, Chris Lanzillo, (See Daily Pilot article with profile of Lanzillo HERE) and describes the members of the firm depicted in the photograph from their website thus: "Look like thugs, every single one of them."  He went on to say, "In my opinion, this is a criminal operation."  "They shakedown cities for perks and benefits."

Thugs?  Really?

POLICE OFFICER PAY
Righeimer provided information about Costa Mesa police pay levels - which sent the show hosts off like a rocket.  He mentioned that the base pay was $65,000, but was enhanced by over 70 kinds
of pay that could take the pay to $131,000 on average.  He said, "You gotta be dead to get base pay."

GREEDY FIREFIGHTER, AGAIN
He also took the opportunity to, once again, bring up the "firefighter who made $347,000 last year and he wasn't even a chief."

 LISTEN FOR YOURSELVES
I was going to provide many more quote but no longer have to since the podcast is available for you to hear on your own.

RIGHEIMER SNUBS ASSOCIATION REQUEST TO MEET
Jason Chamness, president of the Costa Mesa Police Officers Association (CMPOA) has a commentary published in the Daily Pilot tonight, HERE.  The most interesting part of that commentary is the last sentence, "The association did request to meet with Mr. Righeimer, however, he denied our request."

***CHRIS LANZILLO SPEAKS!
The Daily Pilot has an interview with Chris Lanzillo posted on their site, HERE.  Sounds a little hinky to me.  What do you think?

ANOTHER PRESS CONFERENCE TOMORROW
Righeimer announced on this program that he will be holding a press conference - another one - at 11:00 a.m. tomorrow at City Hall where he and other elected officials from around Southern California will address this issue.  I'll be there...

At first it was believable that he (Riggy) was upset, but now its just getting stupid. Me thinks he doth protest too much. Its staring to sound a little "hinky". If he were to meet with CMPD and see what they have to say, it would take away his forum. This is beginning to all sound like a political ploy.

This whole thing doesn't seem totally right to me...

I'm not clear on who would have had the most to gain...CMPD or Righeimer. And seriously, why target the guy not up for re-election? The thing that makes me wonder is that whoever made the initial phone call (or rather, asked for it to be made) had to have known that it would provide a whole new platform for Righeimer. I hope the whole story comes to light, regardless of the outcome.

Riggy's little "set up" had nothing to do with a DUI, Diet Coke, receipts, or young children asking if daddy is going to jail. (I wish.) This bogus fiasco is 100% about passing his Charter! Unions Bad, Charter Good.

John and Ken absolutely hate exorbitant pay scales of union workers. Someone much smarter than Riggy hatched this little “set up” so they could capitalize on it. Messy or Monahan can’t get their hands dirty right before the election, that’s much too obvious. Trust me, no undercover PI would EVER give his real name nor would he hang out at the scene, much less speak to the wife.

Well Costa Mesa, Riggy’s little newspaper, television, and radio blitz is providing amazing coverage for their side. Now, it’s up to us!

VOTE NO ON THE CHARTER AND TELL ALL YOUR FRIENDS AND NEIGHBORS TO DO THE SAME!!!

This is the Breitbart playbook...."manufacture a crisis".
It's the stink eye....on steroids,......it just is.
And all the Righeimer "crocodile tears", publicly shed, over the terrible experience he had to suffer under the egregious professionalism exhibited by our PD, will not change one thing.
His "take over" of our city has been a debacle from day one.........

Could our rotund Righeimer be fudging numbers again? Nah, he would stoop so low as to fudge numbers would he? What? You say he fudged PERS numbers last year? Oh, yeah, I remember that now. What? He released "total compensation" numbers and double and even triple counted some things? You know what, I remember that now also. Dammit, the memory must be going. Thanks for reminding me that Righeimer has a habit of fudging numbers for his own benefit.

Fact is, our little riggy is incompetent. He's responsible for a ton of mistakes that have cost Costa Mesa big money. He has ruined the Republican brand in Orange County. In the long run, Democrats will have to thank Napoleon and his buddies for helping change countywide voter registration with their extremist behavior.

With that whiny Richard Simmons voice, he sounds like that crazy old aunt many families have who sits in the corner and yells at the TV.

Few people believe the phony story, tears, and high school drama of this overfed amateur.

This too shall pass and we will retake our city. My family, friends, and neighbors will always remember those took the 40 pieces of silver and tried to sell us out.

JW - yes it does look that way. And I'm disappointed in John & Ken. I thought they were smarter than to fall for this whole rigged situation. All they had to do was watch replays of cc meetings, even google Righeimer personally - they'd find he tried to stiff his own business's legal firm for almost $200,000.00 until he was court ordered to pay it ( it's not my bill, it's my business's bill). If they did a little research, they'd come up with a whole lot of damning information: sending the layoff notices to city employees against the advice of the city attorney, causing the city to naturally be sued by the city employees association - not done the right way and against their own attorney's advice and against the will of a majority of CM residents; in just this litigation alone Righeimer has racked up $2 million in attorney's fees -so far - with an outside firm at $495.00/hr and no spending cap ( he claims they are defending the city, not just the council union - a lot of CM residents beg to differ with that statement - the cc union sent out those layoff notices, no one else did) - again, not done the right way and against the will of the majority of CM residents; the Righeimer charter, cut and pasted by him and written specifically to accommodate him, done without any input from CM residents groups, whose involvement is the norm when writing a city charter - he even did it without asking the residents if they wanted to become a charter city - not done the right way and against the will of a majority of CM residents - they do not want this charter, doesn't mean they wouldn't be open to a charter, properly researched and written; then the cc union members vote in favor of putting it on the Nov ballot - once again, against the will of the majority of CM residents ( there's a cc meeting replay John & Ken should watch); accepting the first offer of only $4.4 million in traffic mitigation fees from his fellow ABC members - his Banning Ranch developer buddies - selling the city of CM down the river in favor of accepting an agreement from his developer buddies that ensures they will only have to pay a small portion of the actual traffic mitigation costs to CM and it signs away CM's rights in the future to contest anything about the Banning Ranch development (not to mention this legal document they voted to accept has blanks and is therefore incomplete - you never accept/sign a legal document like that) - not done the right way and against the will of the majority of CM residents. This list goes on and on. There is no interest on his part or any of the other 3 cc union members to listen to what the residents of CM want. Righeimer has his own political addenda from the play book of the ocgop. While John & Ken may be sucked into his extreme right wing opinion of unions, they are being distracted from the real issues at hand - Righeimer and his council union members are running Costa Mesa for their own and their special interest buddies' "wants" while completely (and rudely) ignoring the people they were elected/appointed to represent-the residents of CM! And if John & Ken were thorough in their research, they might even question who really was behind this rigged "setup"!

One thing I don't understand. If police came to my door and wanted to talk with me about possibly driving drunk, my first instinct would have been tell my spouse to take the kids to the back of the house, I'd close the door, then step outside to face the cops. I don't know who did what or why. That's not my concern here. Why wasn't his first thought to spare his children?

A Parent --> what would you do if a policeman came to your front door -and your wife answered the door, and the policeman asked to talk to your husband.

If your husband had nothing to hide -- why would you try to shelter your family from the encounter?

Based on the outcome -- JR had no reason to think he would be tested for DUI. Right? Your logic that he should have "spared his children" is a giant leap in logic in my mind.

If he had been driving drunk or robbed a bank, then hide the family because you expected to have a problem with the policeman.

If he had nothing to hide then why should he expect the officer to give him a DUI test on his front porch?

Only if he suspected the CMPD was out to get him for committing a crime would he have tried to shelter his family from a DUI test administered at his home.

Where has the reasonableness in Costa Mesa gone? Isn't it obvious that the unions that have had their way with our politicians in the past are getting desperate to keep their great employment benefits going?

And you continue to attempt to be critical of these leaders that we voted to run our city and to diminish their work to make our city work to the benefit of all our citizens.

Geoff,

Thanks for the link to the John and Ken Show interview with Jim Righeimer that took place this afternoon. The interview was very revealing and provides a great insight to the details of what happened before the CMPD association fired the law firm that has advised them and then their law firm disavowed the PI that was the focus of this encounter. Let's hope the truth of this situation will lead to the punishment of this PI and his bosses.

If there is any upside to Lanzillo's criminal act - he has exposed the morally corrupt cadre that comprises the core anti-council activists.

They are incapable of telling right from wrong.

They think the end justifies the means.

They will beleive any lunatic with a conspiracy theory as long as they oppose the council majority.

This blog has become the headquarters for public expression of the moral relativists.

Congratulations - you stand for nothing except getting what you want.

Obviously, you aren't alone. The jackals at Lackie, Dammier & McGill and all the winners they got off have your back.

Tom Egan - I saved the playbook. If you don't condemn it, you have lost all moral and intellectual credibility with me.

Remember the playbook isn't about the public, it is about coercion:

"Keep in mind that most of these tools are not to deliver your message to the public but are designed to simply get the decision makers into giving in to
your position."

8/28/2012 01:33:00 PM
Anonymous sad but definitely true said...

Full text of the Lackie, Dammier & McGill playbook tools - Negotiations After Impasse, Association Options:

Storm City Council - While an association is at impasse, no city council or governing board meeting should take place where members of your association and the public aren't present publicly chastising them for their lack of concern for
public safety.

Picketing - Plan a few well organized picketing events. Keep these events spread out to avoid burning out your membership.
Public Appearances - During impasse, the association should make known at every significant public event, such as parades, Christmas tree lightings, the
Mayor's Gala and any other event of interest to the decision makers, that the association is upset about the lack of concern for public safety.

Newspaper Ads - Again, keep the message focused on "public safety."
Billboards - Nothing seems to get more attention than a billboard entering the city limits which reads that crime is up and the City could care less about your safety.

Websites - GardenGroveSucks.com was a big hit.

Job Fair - Getting your members to apply at a large local agency, which causes an influx of personnel file checks by background investigators always sends a strong signal. Keep this for last, as some of your members may ultimately leave anyway.

Work Slowdown - This involves informing your members to comply closely with Department policy and obey all speed limits. It also involves having members do
thorough investigations, such as canvassing the entire neighborhood when taking a 459 report and asking for a back-up unit on most calls. Of course, exercising officer discretion in not issuing citations and making arrests is also encouraged.

Blue Flu - This one is very rarely used and only in dire circumstances. As with all of these, please consult your association's attorney before even discussing this issue with your members.

Public Ridicule - Blunders by the City Manager, Mayor, or City Council members or wasteful spending should be highlighted and pointed out to the public at every
opportunity.

Referendum / Ballot Initiatives - Getting the public to vote for a wage increase is seldom going to fly, however, as a pressure tactic, seeking petition to file a
referendum on eliminating the City Manager's position for a full time elected mayor may cause the City Manager to rethink his or her position.

Mailers - Again, the message should be for "public safety" in getting the public to attend city council meetings and to call the City Council members (preferably at
home) to chastize them for their inaction.

Campaigning - If any members of the governing body are up for election, the association should begin actively campaigning against them, again for their lack
of concern over public safety. If you are in a non-election year, make political flyers which you can explain will be mailed out the following year during the election season.

Focus on an Individual - Avoid spreading your energy. Focus on a city manager, councilperson, mayor or police chief and keep the pressure up until that person
assures you his loyalty and then move on to the next victim.

To “sad but true:”

Thanks for the law firm’s “Association Options for Negotiations After Impasse.” I was wondering what they looked like.

I scanned them, expecting, after all the negative chatter here, to find some maneuvers that were illegal. Didn’t find any. Hardball? Yes. But illegal? No.

While I think we all can agree that the Options are not softball, we might keep in mind that these Options are suggested for use by the employees when negotiations have reached an impasse.

For perspective, I’d like to show you the even harder ball that the city can play. Basically, if an impasse has been reached in negotiations, it can be broken by the city unilaterally imposing its “last, best, and final offer.” The employees have no choice but to accept it.

How’s that for hardball? Here’s the State Government Code on it:
3505.7. Impasse; implementation of last, best, and final offer
After any applicable mediation and factfinding procedures have been exhausted, but no earlier than 10 days after the factfinders’ written findings of fact and recommended terms of settlement have been submitted to the parties pursuant to Section 3505.5, a public agency that is not required to proceed to interest arbitration may, after holding a public hearing regarding the impasse, implement its last, best, and final offer, but shall not implement a memorandum of understanding. The unilateral implementation of a public agency’s last, best, and final offer shall not deprive a recognized employee organization of the right each year to meet and confer on matters within the scope of representation, whether or not those matters are included in the unilateral implementation, prior to the adoption by the public agency of its annual budget, or as otherwise required by law.

btw, it looks like that’s what Righeimer is aiming for, since he has said in open meeting that they’re just going to wait until the contract runs out, then impose [the last, best, and final offer.]

In the meantime, by all appearances, he will refuse to negotiate (even though that’s against the law, per 3506.5) and milk the “impasse” for political points, as he did this morning at his press conference.
