Judge Rejects City's Attempt To Dismiss Lawsuit
REQUEST FOR SUMMARY JUDGMENT DENIED
In a press release by the Orange County Employee's Association, reproduced in it's entirety below, we learned today that Judge Barbara Tam Nomoto-Schumann has ruled that the lawsuit filed on behalf of the city employees can proceed to trial. That trial is scheduled to begin April 9th.
DUARTE - LOOKING FORWARD TO DAY IN COURT
Costa Mesa City Attorney Tom Duarte released a statement following Judge Schumann's decision which said, "This is consistent with the judge's previous rulings on the case. The City looks forward to its day in court."

The cheap shot of using Nenadal's deposition didn't work. Does anyone know what it cost us in attorney's fees for the city's attorneys to file and appear on this failed motion?
How many police officers or overtime hours could we have gotten for those dollars?
Well, it said 6 attorney's were their on behalf of the City, so hmmmm....at $300+ an hour multiplied by 6. What a waste!
And the coun-sell wants to save money by outsourcing??
Their decisions have surpassed any cost savings whatsoever. Why don't they just follow the rules and we wouldn't be in the mess they created in the first place.
Actually, Dave, those Jones Day attorneys are $495 per hour... only Duarte is less costly, depending on how you view it.
What a bunch of losers Riggy and Messy are. They keep pissing away tax dollars on their schemes, but they can't every get anything done.
If they had been competent at all, they would have had at least a few departments outsourced by now and the FD turned over to the Fire Authority for long term savings.
Buffoons.
If saving money was ever the actual intent of our corrupt coun-sell. They would have simply asked all the employee associations to make some concessions just as it has always been done prior to Riggys hostile takeover. It's just more and more obvious that this is a scheme to keep Riggys pudgy face and name in the news.
