Jury Finds For The City In Acosta Trial
JURY REJECTS ACOSTA'S CLAIM
As reported by Joseph Serna in the Daily Pilot just after 1:00 p.m today, the federal jury in the trial of the City of Costa Mesa and Mayor Allan Mansoor brought by the ACLU for Benito Acosta has found for The City. You can read Serna's account HERE. Those familiar with this case will find the error in Serna's reporting wherein he reports that Acosta called Mansoor a racist in the meeting in question. He did not. He did call Mansoor a racist in much more descriptive terms that were completely unacceptable and that I won't repeat here at the meeting a month earlier.
Ellyn Pak in the Orange County Register also wrote an article on this verdict HERE.
APPEAL UNKNOWN
It is unknown at this time whether Acosta will appeal this case.
LET THE GLOATING BEGIN
I fully expect the gloating and cat-calling to proceed now, as those folks who are ardent Mansoor supporters will jump on the anti-Acosta bandwagon.
TIME TO MOVE FORWARD
This issue is behind us now and, although the jury reached a verdict that, in my view, contradicts the video evidence, The City needs to move forward from this point.

Just in case you wish to view the whole scenario again, here's the YouTube clip of the event in question.
ACOSTA TOSSED FROM COSTA MESA COUNCIL MEETING - 1/3/06

This was a frivilous lawsuit that should never have seen the light of day.
Oh, I don't know about that, Allan. Freedom of speech is still important and worth fighting for.
Acosta was clearly trying to incite a riot. Deputy sheriffs and police officers are trained to get a handle on something like that before it gets out of control. That's why Costa Mesa won the case, and why they will win again if the case is appealed.
Frankie
Anonymous "Frankie", if you mean Mansoor when you refer to Deputy Sheriffs, understand that he spends his work day dodging fecal matter in the jail. Acosta clearly WAS NOT trying to incite a riot - he was trying to have his supporters stand and be acknowledged, just as Mansoor had permitted his buddy, Jim Gilchrist's to do 30 minutes earlier.
I wasn't in the jury room, so I don't know what they discussed in the hour it took them to arrive at their verdict.
Justice was served why can’t you admit it? Acosta made a demand of the city council. Listen to the tape he specifically used the word. He then asked for people in the audience to rise showing support for his antics. The mayor asked him to stop. He ignored the mayor and hi-jacked the meeting. The mayor and police acted appropriately. You are correct in that it was a previous meeting that he was again disrespectful and chose to swear to make his point. He’s not some dumb kid he knows his actio0ns were not acceptable but he also knows this is how to make $$$. He wasted a lot of tax payer dollars with this fiasco in an attempt to get rich.
You'll have to look for other ways to fabricate racism. It’s pretty clear you don’t like most of our elected officials. Time to move on.
Gallo, or perhaps it's gallows, I admit the jury system worked, but I don't have to like it. As far as me "liking" our elected leaders - that's not required. I don't have to like them, but it would be nice if I could respect them. Sadly, with most of the current crop I can do neither.
