Breaking News! City To Appeal Decision

REPORT FROM THE CLOSED SESSION
Contract City Attorney Tom Duarte reported out of the Closed Session this evening two items.

CITY ADDED TO ORIGINAL PETITION

First, on a 4-1 vote (Wendy Leece voted NO) the Council directed the City At
torney to amend the petition filed by City Clerk Julie Folcik, and "to add The City as a party to the petition, thereby ratifying the City Clerk's original filing of the petition".

CITY AUTHO
RIZED TO APPEAL DECISION
Also on a 4-1 vote (Leece again voting NO) "the Council provided the city with authority to appeal the lower court's decision earlier today".

MORE LEGAL FEES
So, I guess the Fat Lady has not yet sung on this one. The drama continues and that Jones Day meter just keeps on a'spinnin'. I guess it's a good thing the council approved using them on this case in the open session earlier in the evening, huh?

Au Contraire, my dear. You will recall that Righeimer voted NO on the authorization to shift funds to the Self Insurance Fund from the General Fund. That means, unless they change their minds, Bobby Young won't be able to cut checks to Jones Day when the cash runs out!

Awww cool your jets GW- I'm sure Scott Baugh, Mensinger, and Riggy will kick in their own money to help fund the appeal.

There you go jumping to conclusions, that somehow the City will pay 7 figures in legal fees before the extremists are done..

Where's Colon and the "Taxpayer Association?" Why aren't they picketing on Fair Drive while our money's getting squandered?

When will any blame be put on the City Attorney for this SNAFU of the missed deadline. Ultimately he should of had a set of eyes on all the paperwork and the dates. Don't think your out of the hot seat Tom, you'll be replaced in a heartbeat by these numb-nuts and they'll find another sheep to add the flock of incompetence.

Ho,hum. Did anybody really think that a judge's decision would ever make any difference to the 4-1 majority? "City to appeal Decision" is nothing if not expected. Means more money for Jones Day.

I propose we designate March 27 as "Costa Mesa Jones Day" and celebrate it annually by burning a bushel basket full of ten-dollar bills. That way there would be no remote possibility of kickbacks from a law firm to the city council members, the price would be the same, and we would also institutionalize the currently most popular law firm in the city in Costa Mesa history, as well as memorializing Mr. Righeimer's covetousness (another meaning of "jones") and desire for a city-wrecking charter...

OK, Terry, you've made my long, long day end on a happy note. Thanks for that - and you didn't even have to sing it! ;-)

Sanitary District, per Art Perry, will spend whatever it takes of taxpayer monies to try to oust Mr. Jim Fitzpatrick. Unbelievable.

Can these guys really believe appealing this decision rather than just waiting until November is in the best interest of the city? Costa Mesa is sinking to the depths under this "leadership" (I use the word very loosely). Before too long, we will be just the same as Stanton was financially back when they went to county. I can see a day when Newport will be so embarrassed by their neighbors to the north that they will form their own school district and go their own way completely. Of course by then all of these bozos will be on to bigger things. Piggy will have moved to yet another city and run for another job as everyone here will be REALLY sick of him by then. SO sad.

Boom goes the dynamite!

Is this another checkmark in Righeimer's failures?

As long as he keeps going down this path, forget about CMPD, we as citizens might have to get our own billboard for the upcoming election year....HAHA!

Appeal away Riggy! What do you care, it's not your money, it's our taxpayer money.

Oh and to all you council supporters...Cry me a river and stop blaming Folick. If Righeimer was so smart he should have kept tabs on this himself and made sure personally this was all handled in a timely manner.

Oh well, but what do the fiscal conservative council and council supporters care right? Like I said, we are on the hook for the bill and the appeals bill. Please, someone defend this!

Council Stinks:

The council huggers (I'm coining that as opposite of "haters") will have a hard time defending the appeal. You might get one or so "they are defending the democratic process...". However hat we will likely see as has already been done is their typical off point red herring. They will liken it to the San District fight with Fitzy and the use of ratepayers dollars in that fight.

I tell ya what, if it means getting Fitzy out, I will personally kick in and I will pass the hat. All of this among the huggers is arrogance at its worst. There is not an ounce of humility among the men. They are not citizen servants, nor are self servants. "I" and "me" are their favorite words.

other mike: you got it! If you want Fitzy out use your own money. spot on mate. Art Perry wants to use ratepayer money, no matter what it costs. this should be brought forward by a private citizen like Foley with her time/money.

This is rich!

"Oh and to all you council supporters...Cry me a river and stop blaming Folick. If Righeimer was so smart he should have kept tabs on this himself and made sure personally this was all handled in a timely manner."

I thought you hated council interfering with employees or telling them what to do? Isn't that Hatch's job? That must be why you hate the charter so much - it prohibits that type of interaction...

Make up your mind.

Rich-

Well Hatch is Righeimer's puppet so he should have paid more attention to his lap dog and made sure his Charter scheme was done in a timely manner.

CM council should stay away from city employees but you and I know that doesn't happen.

I made up my mind a long time ago .

Rich, let me ask you a question? What do you think of all the money being spent on legal fees and consultants?

Actually, forget about the legal fees, what about the jobs the council has created at city hall, which by the way are entitled to PENSIONS. The same pensions, which you council supporters are saying will bankrupt the city.

I'll expect an answer soon....Thanks!
